There are a number of practices associated with contracting and tendering in the UK construction industry which demonstrate a lack of good faith among the parties involved. It is common, for example, for members of the professional team not to disclose all they know to potential contractors, while employers may choose not to reveal information about the physical characteristics of a site. Lack of bad faith may occur when a tenderer is given the opportunity to revise a bid or where the bidding procedure is too selective.

Professionals working in the UK construction industry who are called upon to act as expert witnesses must be aware that they cannot express opinions. Their only role is to testify to the facts as they know them. The evidence provided by the expert witness must be objective, and must not be influenced by the pressures of the litigation process. A solicitor must strike a careful balance when seeking to use an expert witness as part of the client's team but also ensuring that the evidence remains independent and impartial.
