Beware of contract 'killer clauses'

Insulation contractors are warned over the emergence of a number of unfavorable clauses in builder contracts. The unfavorable clauses deal with the areas of indemnification, additional insured, and dispute resolution. In indemnification, the unfavorable clause shifts the legal liability from the contractor to the subcontractor. In additional insured, subcontractors are asked to include contractors as 'additional insureds' on their liability insurance policies. In dispute resolution, an interested party such as the architect is designated as judge, jury or executioner on any dispute between owner, contractor and subcontractor.

Business in 1999 was disappointing for most siders, with only 20% reporting an increases in business

Siding contractors reported flat growth in 1999 as a result of lower volume and problems associated with labor shortage. Around 20% of the contractors registered increases in their business while 13% posted declines in their volume, with most of the contractors (60%) reporting a flat volume. The residential market is dominated by vinyl, which accounts of 72% of the average sider's volume, while wood siding accounts for 20%. The remaining 8% is shared by steel, aluminum and siding.
