UK law is fairly clear that building design consultants have a legal obligation to review their designs for defects whilst a project is under development, but it is less clear about the situation following completion of a project. Legal cases have given rise to differing interpretations of the issue, but they have not stated that design consultants have a definite duty to review completed projects. Consultants who do give advice relating to past projects may find themselves liable for that advice. The lack of clarity indicates that consultants should be specific in their contracts.

Planning supervisors can face difficulties if their contract sets out terms which differ greatly from or go beyond the duties expressed in the Construction (Design and Management) Regulations. If the duties expressed in their appointments are not the same as those set down in these regulations, then they could be in contravention of their contractual obligations. A planning supervisor in this position could face criminal prosecution and a fine. It is particularly important to avoid giving collateral warranties to future owners or occupiers.

Article Abstract:
Issues concerning the responsibility for safety in building design are discussed. The proposed changes to the Construction (Design and Management) Regulations being made by the UK Health and Safety Commission are described.
