CMS Cameron McKenna Partner Ann Minogue points out some contract clauses are included in contortion industry contracts between clients and the contractors because the contractors often fail to supply the correct documentation on time. Specialist Engineering Contractors' Group Chief Executive and Barrister Rudi Klein suggests one side should not be unfairly penalised as all sides do not always product the necessary documentation. A supplier should not be forced to forgo payment because the relevant paperwork has not been submitted.
