Article Abstract:
The case of Sylvia Berwick vs Wickens Holdings Ltd and others highlights important issues relating to responsibility for defective construction. In this case, it was ruled that no building surveyor, structural engineer, architect or builder could have identified the problems that caused an office building in Ashford, England, to collapse in Aug 1995, killing four people. It is clearly very dangerous to rely on old drawings or on an individual's recollection of what happened a long time ago. It must also be remembered that buildings are not constructed according to the plans. When altering a building, it is vital to take all possible safety precautions.

One bad apple: OK, there is the odd claims consultant who milks the system and is on the look-out for an expensive dispute. But the vast majority do their job perfectly well and legitimately

Michael Reynolds, a solicitor, spoke at a conference organised by Construction Law Training, about claims quantity surveyors and how some give the construction industry a bad name. Their claims mentality he believes is to stalks events to produce a claim at a certain time, or to cause a difference of opinion that could cause a dispute to go into arbitration or litigation. However, the vast majority of claims surveyors do their job well and act legitimately.

Insurance premiums are set to rise for individuals who find themselves caught out by the ever increasing number of speed cameras dotted throughout urban and rural areas of the UK. Construction industry project managers are likely candidates to be caught by the speed cameras as they are forever dashing between one project and another, with the pressures of time on them increasing all the time.
