Companies and legal aid
Article Abstract:
Companies in the UK are unable to use the Legal Aid Fund when facing court proceedings, only individuals with limited assets are eligible. Even if the company wins the case, it must pay its own costs since Legal Aid clients cannot be ordered to do so. To overcome this problem a subcontractor may assign to an individual the right to sue, enabling the individual to apply for Legal Aid, thus obtaining funding for the litigation without the threat of paying costs if the case is lost.

Article Abstract:
A ruling relating to the conduct of the arbitrator dealing with the case of Gbangbola vs Smith & Sheriff Ltd indicates that some arbitrators in the UK are failing to comply with the basic provisions of the 1996 Arbitration Act. It was found that the arbitrator had not behaved fairly in this case and had exercised his costs discretion incorrectly. This case shows that some arbitrators have still not completely understood their basic obligation to act fairly and impartially.
