UK specialist construction firms have a legal right to the refunding of retention payments, although many contractors refuse to make payments in full because of the lack of a certificate of making good defects (CMGD). A UK court ruling has stated contractors are legally entitled to take agreed amounts from retention monies although the subcontractor still has total legal rights over the fee and therefore final payment. The issuing of a CMGD will not affect the rights of a subcontractor should the case go to adjudication.

The interpretation placed on the Landfill Tax (Contaminated Land) Order 1996 by HM Customs and Excise is creating problems for developers seeking an exemption from landfill tax. Under the legislation, a project to reclaim a brownfield site is eligible for exemption from landfill tax if it satisfies certain conditions for reducing or removing pollutants. HM Customs and Excise local officers are turning down many applications for exemptions, and the BEC believes that in doing so they are breaching the order.
