Article Abstract:

The increasing use of design-and-build contracts within the construction industry is motivated by the attractions of single-point responsibility. However, maintaining such responsibility for all aspects of the construction process requires the design-and-build contractor to be accountable for all design defects, even if they existed before the contractor was involved in the project. The advantages and disadvantages of novation are discussed.

Article Abstract:

The legal aspect of a partnering charter will fail to protect individual parties should something go wrong, whereas legally drawn up contracts will provide some redress in a court case. Partnering charters are often used where two parties feel they have the total trust and respect of the other, although things can always go wrong on a construction project, which means legal protection is essential.

Is there a bond that works?

Article Abstract:

The Institution of Civil Engineers Bond and the Association of British Insurers bond were introduced in 1994 and 1995 respectively, in response to two court cases that were based on the inadequacies of performance bonds. However, neither of the new bonds has gained widespread acceptance and the most appropriate workable solution would seem to be a compromise between them.
