Article Abstract:
The introduction of the UK Competition Act in March 2000 could have a serious affect on the construction industry which relies on a degree of partnering and collaboration. The use of collusive contract tendering will be strictly prohibited which should prevent the power of cartels. The act will also put an end to price-fixing which is covered under the prohibition of undertakings arranged by associations or joint ventures. The threat of a jail sentence or heavy fine faces those who fail to comply with the new legislation.

Article Abstract:
Construction industry bonds are failing to provide adequate protection for firms who take them out because the wording is too complex and legal for a true meaning to be interpreted. Many construction bond disputes have to be resolved in court because of the difficult nature of the wording. Bonds should be drawn up so both parties fully understand the implications associated with the contract without the need to have a legal education.
