Southwest Harbor, ME-based Hinckley Co's 1998 application with the Patent and Trademark Office to register 'picnic boat' as a trademark has triggered a dispute which has rippled through boatyards from Maine to Florida. At least three smaller boat builders have filed protests with the Patent and Trademark Office, claiming that the term 'picnic boat' has been used extensively as a descriptive or generic term and that their business would be adversely affected if they stopped using it. Hinckley launched the Hinckley Picnic Boat in 1994 and has sold more than 150 units of the model.

Article Abstract:
Egg Harbor Yacht Co is now resurrected as Egg Harbor LLC, thanks to John DiDonato, a New Jersey developer and property manager. DiDonato has purchased some of the defunct company's assets and leased some from the state. He eventually plans to build two to three dozen boats a year, selling a range of 42- to 72-foot models. His flagship, though, would be a 52-foot model he had purchased.
