Health and safety catch: will the role of planning supervisor, created under the new CDM site safety law, alleviate the health and safety duties of the client, designer and contractor?
Article Abstract:
The role of the planning supervisor, with responsibility for the documentation and monitoring of health and safety relating to building projects, has been created by the Construction (Design and Management) regulations 1994. The client must select a planning supervisor and must provide information about the site. The planning supervisor can recommend designers and contractors on the basis of their capabilities in health and safety.

Sharpening one's clause
Article Abstract:
Legal experts have developed an extra clause which can be added to construction industry contracts to place adjudication awards into stakeholder bank accounts and delay payment while still earning interest. Industry experts claim the clause is unfair to subcontractors who will not be able to afford payment delays while adjudication takes place, forcing them to accept unfair contractor decisions.
