Information outside the laws of copyright can only be protected by a confidentially agreement. Other items, such as documents, designs or software can be licensed to clients. Licenses should not give clients all the rights to a piece of work therefore it is vital licenses are drawn up carefully. Licences covering software should clearly outline how clients may use the program. The licensing agreement should not be for any longer than the project. Clients may be charged a fee for the licence but it can be difficult to collect the fee without threatening to withdraw the license.

Courts in the act
Article Abstract:
The 1998 UK Arbitration Act includes the principle of party autonomy which allows arbitrators to rule on their own jurisdiction without interference from the courts. Section 9 of the act takes away the right of the court to dispense with the arbitration clause. The courts had used their powers, in the past, to prevent inconsistencies and opposing decisions from the various parties involved. The Joint Contracts Tribunal in its Amendment No 18 allows the choice of litigation or arbitration. Some European lawyers have expressed their concern over the new act.

Passing the liability parcel
Article Abstract:
The Egan report on the UK construction industry is not likely to clarify the question of liability. Contractors and building consultants may find it necessary to combine to cover the risk of litigation. The reintroduction of latent defect insurance may be helpful in some cases, if clients will pay the premiums. Egan has recommended greater integration of working, with contractors involved at a much earlier date, therefore it will be harder to decide who is liable in a dispute.
