Short cut leads to legal cul-de-sac
Article Abstract:
Legal disputes can be shortened by breaking a case into small parts but this can lead to more complications where all the facts are not available. The case of Schal International v Norwich Union Life Assurance Society illustrates the difficulties faced by the judge when asked to answer questions related to a contract. Although clarification of the contract was at issue, the judge was unable to answer any of the points because he did not have information on later agreements. He was offered documents relating to pre-contract negotiations but these are not valid.

Typical specifications should include: definition of the scope of work; definition of the scope of the services to be provided; definition of the site; specification of legal obligations; provision for indemnities for personal injury and third party loss; maintenance of professional indemnity insurance; retention of warranties for statutory licences that are kept up-to-date and the specification of provisions for payment and damages.
