Article Abstract:

There have been a number of legal cases recently which have highlighted important issues for the UK construction industry. One case indicated that contractors need to take care about access over a private roadway, while another highlighted the importance of complying with regulations known as automatic directions when involved in a county court case. Another case dealt with the question of whether an arbitrator had the right to claim an interim payment from the parties by which he had been appointed.

Article Abstract:

The case of How Engineering Services v Lindner Ceilings, Floors and Partitions highlights several issues about the role and responsibilities of arbitrators. It is clear that arbitrators, and the parties, must make every possible effort to identify the exact cause of loss, the exact right to claim and the exact calculation of loss. It is advisable for arbitrators to present their reasons, analysis and tests used. This case remains unresolved, and may well go the Court of Appeal.
