The conditions contained in John Mowlem Construction's subcontract seem to be closely aligned with those of the 'blue form,' the subcontract designed by the Federation of Civil Engineering Contractors. However, there are a number of amendments and omissions which have the potential to give cause for concern. Overall, the conditions are one-sided, and may create an unsound basis for a contract. Areas of concern include determination of the main contract, site working and access and instructions and decisions.

Subcontractors should be very cautious about the 13-page subcontract used by Birse Construction. The conditions of this subcontract contain a large number of provisions which could potentially cause problems for subcontractors. Furthermore, they could have a negative impact on the reasonable balance of standard DOM/1 conditions. Areas of danger include rules relating to daywork sheets, with the subcontractor having to overcome a number of barriers before payment can be obtained.
