The UK government expressed strong support for the 13 principles for a workable form of contract drawn up by Sir Michael Latham following his investigation of the construction industry. However, there are still many sensitive issues to be resolved, and the construction industry remains in a state of confusion. Little real progress has been made towards Latham's key aims, including an industry-specific amendment in the law regarding post-completion liabilities and the abolition of 'several' liability.

The successful termination of a commercial contract relies on contractors drawing up a detailed and exacting contract which covers all eventualities concerning termination. Contractors may face heavy financial penalties for failing to comply with procedures set out in contracts if termination is applied. Firms found to be in breach of contract will be liable for damages from the other party.

The mechanics of quantum
Article Abstract:
The UK's new Construction Bill allows for disputes between contractors to be decided by courts or arbitrators, with speedy adjudication being a central requirement. However, the new rules leave the issue of the size of damages unresolved. The distinction between liability and the quantum of damages is analysed.
