Not so super supervision

Article Abstract:

The case of George Fischer Ltd v Multi Design Consultants and Davis Langdon and Everest sheds valuable light on the role of supervising officers in construction contracts in the UK. Davis Langdon and Everest acted as supervising officer on the construction by Multi Construction, which had links with Multi Design Consultants, of a warehouse for George Fischer. When the warehouse roof was found to leak, Fischer took legal action. It appears that Davis Langdon and Everest, as supervising officer, was responsible for approving the roof design for the warehouse. This may not apply to all supervising officers in all building contracts.

Better late than now

Article Abstract:

The delayed enforcement of the 1996 Housing Grants UK Construction and Regeneration Act is thought to be a good thing because adjudication and payment regulations have yet to be finalised. The construction industry submitted 2000 comments during the consultation period, preventing the law from being enforced on schedule by Jul. 1997. Constructive discussions are expected to go on into 1998. The industry will also have the chance to cater for forthcoming regulatory changes.

Article Abstract:

The UK's new Construction Act includes an adjudication scheme which becomes law in early-1997. The new rules introduce the concept of 'temporary finality' binding the parties involved in litigation to the decisions of an independent adjudicator. An explanation of how the new act will work is presented.
