Winners and losers in planning change

Article Abstract:

Proposals for UK regulations on the modification and discharge of planning commitments face problems due to the 5-year rule. It states that no changes can be made until after the period. Many circumstances could occur affecting the viability of any commitments made. The DOE (Department of the Environment) has issued a draft policy on planning and pollution which has provoked comments that overlap and duplication may result. The proposals set out the way in which authorities should deal with planning applications that also require pollution control.

Third parties and litigation

Article Abstract:

Funding by a third party is permitted in litigation cases within the United Kingdom legal system, but it is not always clear when this is permitted. To clarify the rules, the courts permit a third party to provide finance for the litigating party as long as it has no personal involvement in the case. In return it will receive a share of any awards made by the court. Third party assistance will be denied if the agreement goes against the public policy or in the case of an individual claiming legal aid, involvement is against the public interest.
