Court backs EPA, states on nonpoint authority

A district court has ruled that the EPA and the states have the authority to identify waterways polluted by nonpoint sources and to limit the amount of pollutants that may enter those waterways. The court decision affirms the Clean Water Act's Total Maximum Daily Load program, which inlcudes nonpoint source pollutant in the act's water quality standards. The case invloved an EPA decision to include the Garcia River in California in the list of impaired waterways.

Arsenic deadline remains despite uncertainties
Article Abstract:
The EPA's Water Office has announced that it is exerting all efforts to meet the Jan 1, 2001, deadline for a revised standard on arsenic in drinking water but pointed out that many ambiguities remain to be addressed. The agency has proposed a reduction in arsenic concentration from 50 parts per billion to 5 parts per billion. It sought comments at a meeting in Reno, NV, that was attended by the representatives of many groups with a stake in the proposed new rule.

TMDL battle continues on Capitol Hill
Article Abstract:
The House Subcommittee on Environmental Appropriations has passed a bill that would delay issuance of the EPA's proposed new rule on total maximum daily loads (TDMLs). The EPA has hailed TDMLs as fundamental tools for identifying remaining sources of water pollution and attaining water quality goals. However, its critics in Congress believe that TDMLs interferes significantly in state anti-pollution programs and its economic impact has not yet been assessed.
