Conquering the contract dragon: don't let the jabberwocky of a managed care agreement fool you. Make sure you know your risks before signing

Article Abstract:

Physicians should pay careful attention to managed care agreements or they may subject themselves to unnecessary risk. For example, if a clause states that the physician is solely responsible for the medical care of the enrollee, the physician will be liable if the patient sues, even if the physician followed the organization's treatment decisions. In addition, physicians must renegotiate their contract annually to ensure that their fees keep up with medical inflation and other costs. Several other managed care contractual issues are discussed.

Physicians in Arizona are being thwarted in their efforts to form a union at Thomas-Davis Medical Center in Tucson, AZ. The owner of the clinic, Family Practice Associates Medical Management (FPA), has appealed to the National Labor Relations Board and has taken other measures to impound ballots from the physicians' December 5, 1996, union election. FPA and attorneys for the physicians are both gearing up for possible legal action.
