States and feds bounce reform ball back and forth

Article Abstract:

At least 18 states, tired of waiting for the federal government to act, are proposing a variety of healthcare reforms. To encourage innovation, the Robert Wood Johnson Foundation is funding some of these state tests. National reform is the ideal, and states are hoping to force the issue by passing reforms of their own. However, states need flexibility on federal laws, such as the Employee Retirement Income Security Act of 1974 (ERISA), in order to enact healthcare reform. To date, only Hawaii has received an exemption to ERISA and instituted a universal coverage system.

The health insurance industry proposes universal health insurance with standard fees and benefits set by the federal government, according to a statement by the Health Insurance Assn of America (HIAA). The plan requires purchase of private health insurance by individuals, provision of coverage to everyone, and expansion of managed care. The 1,500 private health insurance companies would retain freedom to compete. HIAA expects members to review the proposal before adoption.
