Continued exposure of banks for environmental damages
Article Abstract:
The CERCLA was created to hold the owners and operators of facilities liable for environmental damages that occured during the time they controlled the facility that released hazardous materials. However, the CERCLA also holds a secured lender with an 'indicia of ownership' to the property accountable for environmental damages. The EPA has proposed a number of guidelines that will exempt lenders from liability. A lender will remain exempted provided that when the borrower defaults, they restructure the loan application, extend the payment period, require higher interest and offer alternatives for the management or protection of the lender's security interest. The borrower must also remain in total control of operations, with no participation from the lender. These guidelines also allow the lender to monitor the facility and insist that borrowers dispose waste properly and obey environmental laws.
