Serta files lawsuit against rival Simmons

Serta has filed a lawsuit against bedding industry competitor Simmons for alleged infringement of Serta patent and trademark. The suit, which was filed in US District Court in Chicago, IL, maintains that Simmons' top-of-the-line Beautyrest Crescendo mattress line infringes on a patent awarded to Serta om 1994. Serta also claims that the name Crescendo was already used by Serta licensees for around two years before Simmons launched its line in 1996. Despite Serta's failure to register the name with the US Patent and Trademark Office, the company still claims that it has common rights since it was the first to use the name. Simmons is being sued for unspecified damages by Serta, which also seeks a court order for Simmons to give up the profits it earned on the products in dispute.
