Allison v. Dugan, 14 EBC 2559 (7th Cir. 1992)
Article Abstract:
The Seventh Circuit Court of Appeals upheld the trustees' decision in the Allison versus Dugan case to syspend early retirement benefits until participant ends disqualifying employment. Disqualifying employment was considered as employment in the construction industry or other covered industry or the same trade or craft or supervisory activities relating to such trade or craft. In addition, the court also ruled that simply claiming that the trustees acted in bad faith without the necessary support for that claim was not sufficient to prevent entry of summary judgment.

Guranteed investment contracts (GICs) continue to be one of the most popular life insurance pension products in the market. GIC funds are most in demand among defined contribution plan participants which has resulted in a continuing demand for products with GIC's basic elements within the defined contribution plan market. However, traditional general account GICs and GIC alternatives differ in contract structure and sharing of investment risk as well as in asset composition.
