Military reservists' rights to civilian reemployment
Article Abstract:
Certain service members have the right to reemployment upon commpletion of service regardless of the length of the tour as provided under section 2024 (d) of the Veterans' Reemployment Rights Act. The Supreme Court ruled in the King versus St. Vincent's Hospital that William "Sky" King, a member of the Alabama National Guard, was not unreasonable in requesting a three-year leave of absence and reinstatement upon completion of duty from his employer St. Vincent's Hospital. The Court stated that the absence of durational limitation in the statute is for the unconditional protection of job security for those in service.

Morganbesser v. U.S., 14 EBC 2601 (D.Conn. 1992)
Article Abstract:
The District Court of Connecticut found in the Morganbesser versus US case that the International Union of Operating Engineers Local 478, A-C-D-E Pension Plan qualified for tax exemption under ERISA's section 501 (c)(5). Moreover, the court also ruled that the plan's appointment of trustees representing both employees and employers did not hinder in any way its claim for exemption. Under section 501 (c)(5) an organization that is not a labor union may be entitled to tax exemption if it conducts activities appropriate for an exempt labor union.
