Six different appellate court cases on significant health benefit issues, are detailed. Of these included is, a breach of fiduciary duty claim in the Tegetmeier v. Midwest Operating Engineers Pension Trust Fund, 390 F. 3d 1040 (7th Circuit, 2004) filed by Allen Tegetmeier.

Third Circuit rejects "elimination" of retirement-type shutdown benefits

The accrued benefits by plan amendment in qualified pension plans cannot be eliminated according to a decision made by the Third Circuit of the US Court of Appeals.
