Impact of Travelers on self-insured plans
Article Abstract:
The Supreme Court decided to allow a state surcharge on hospital bills paid by health insurance companies and health maintenance organizations. However, the decision excluded self-insured plans as subject to the surcharge. The ruling evaluated the impact of the Employee Retirement Income Security Act of 1974 (ERISA) on surcharges imposed by states, and it found that such surcharges did not conflict with ERISA.
