Article Abstract:
Psychological and emotional injuries have been defined as inclusive in bodily injury liability, according to a New York Court of Appeals ruling in Jun 1992. Workers' compensation already recognizes mental and physical injury as worthy of compensation, and tort law on bodily injury is expected to follow suit. Several cases tracing the evolution of workers' compensation and rewards for psychological damage are discussed. The interpretation of bodily injury is expected to have wide-ranging effects on general liability coverage.

Will the ADA disable workers' compensation?

The Americans with Disabilities Act is an area of particular concern to casualty underwriters. Their fears are exaggerated. Although the Act prohibits discrimination against the handicapped in the workplace, it allows employers to deny employment to those who might pose a significant risk. Employers are authorized to conduct medical tests on job candidates. Underwriters can rely on information provided by the growing cadre of physical therapists who design these tests.

Easing the strain of back injuries
Article Abstract:
Preventing lower-back injuries can help reduce workers' compensation losses incurred by insurance underwriters. Lower-back injuries are responsible for 25% of all workers' compensations loss costs, and they are forecasted to increase in frequency and costs due to the aging of the work force in the US. To reduce losses insurers need to identify occupations that are of high risk and mitigate the risk the risk as much as possible.
