Arbitration improves the justice system
Article Abstract:
Arbitration is usually a fast and inexpensive alternative to a justice system to which most attorneys and many others automatically resort. Nearly all cases are decided within a day of the hearing's conclusion and in a less confrontational manner that is easier for all involved. Lawyers should remember to advise their clients that a trial in court may not be the best solution to their problem. The process of alternative dispute resolution is explained, with emphasis on arbitration but some reference to mediation.

Intellectual property disputes: arbitrating the creative
Article Abstract:
Arbitration is remarkably well suited to settling intellectual property disputes and the rules governing it in many countries make its decisions binding on other parties as well. The parties can choose arbiters who understand the technical aspects of a difficult case rather than accepting a state-appointed judge. It is easier in arbitration to keep trade secrets from the opposition. Parties with ongoing relationships can arrange for the same tribunal to oversee different but related cases over time.

The role of arbitration in the field of patent law
Article Abstract:
The historical prejudice against arbitration in patent disputes changed in the early 1980s, when Congress enacted 35 USC 294 and the US Supreme Court recognized that computer software and living-organism engineering are patentable. 35 USC 294 recognized arbitration as an alternative form of dispute resolution. The Supreme Court decision increased litigation over patent rights involving technological products, and arbitration can reduce that burden on the courts.
