The United States' approach to international civil litigation: recent developments in forum selection
Article Abstract:
Consideration of the issue of forum selection in international civil litigation concerns the factors of process in accordance with the Hague Convention on Service Abroad, US personal jurisdiction law, and lis alibi pendens. Federal Rule of Civil Procedure 4(k)(2) expanded the scope of federal jurisdiction beyond former situs state limitations. Analysis of forum selection cases demonstrates how the US can improve its international lawmaking processes.
