Article Abstract:
An English case applying a ruling by the European court of Justice on liability for breach of competition law pertaining to Community law is examined. Both the national judgments applied the ruling by the Court of Justice on the point of Community law, the High Court did not award damages to the claimant but the Court of Appeal did award damages and this judgment is welcomed as a desirable development in the area of remedies for breach of directly effective Community law.
