Benevolent Ivy League conspiracy
Article Abstract:
The case against eight Ivy League institutions and the Massachusetts Institute of Technology, US v. Brown University, which charges that these institutions' coordination of financial aid constituted price fixing is weak. It is true the colleges determined financial aid by need rather than by merit. Yet, their claim of wanting to avert a bidding war for the brightest students seems to have been made in good faith. The resemblance to price fixing in the business world is tenuous since the output of students remained the same and the price became more equitable for all.

Justices finally tackle 'foreign conduct.'
Article Abstract:
The US Supreme Court has ruled in Hartford Fire Insurance Co v. California that US antitrust laws apply to foreigners extraterritorially when the conduct has a substantial impact inside the US. The court also ruled that self-imposed restraints on jurisdiction due to international comity may not pertain unless foreign law requires that citizens contravene US antitrust law or unless compliance with both countries' laws is otherwise impossible.
