Consolidations in health care raise unique state and federal regulatory issues, but the U.S. antitrust agencies have had little success in challenging the deals
Article Abstract:
The health care sector generally and in particular the managed care sector has seen very rapidly increasing merger-and-acquisition activity. Hospital mergers in particular have been the focus of antitrust attention, but the Department of Justice and Federal Trade Commission have not had much success with antitrust challenges. Challenges to managed care mergers have been far fewer in number, although with the continuing consolidation of the managed care industry these will probably increase. The most unpredictable part of a manged care deal is regulatory approval.

Reform the potential attorney-notary conflict
Article Abstract:
The preferred statutory treatment attorneys receive compared to notaries does not avoid the fundamental conflict between the two roles, as notaries are commissioned public officials with the legal obligation to be impartial witnesses and lawyers should not serve in both a private and public role in a single transaction. Clients should find it unseemly when attorneys notarize documents they themselves have prepared. A lawyer-notary owes the client the duty of loyalty, while a notary owes that of impartiality.

Why notaries get little respect
Article Abstract:
Notaries public in the US are on the whole unprofessional and poorly trained, with their huge number - 4.5 million - out of all proportion to the benefits they can offer. Few are able to effectively perform their core function, ensuring the integrity of documents, and other sanctions mean relatively few documents truly benefit from notarization. State-mandated requirements and surety bonds are inadequate, and should be drastically increased. Overseas notaries receive and earn far more respect.
