Container transportation and anomalies in the law
Article Abstract:
Third-party cargo purchasers have few options when faced with damaged cargo from full-container-load, or shipper-packed, shipments because the cargo handler is freed from liability, action against the seller is often unenforceable and negligence is hard to establish. An international convention is necessary to resolve the conflict of laws, jurisdiction and liability issues though national laws could resolve some problems. An Australian proposal involves a status certificate from the seller but limits liability to misrepresentation.

A venture capitalist describes some of the poor investment decisions he has made. One of these is investing in a good idea without the proper person to implement it. The Silicon Valley suffers from the same lack of management talent. Investors pour money into companies with no tangible business plan.

Issues are presented concerning the effect of the Convention on the International Trade in Endangered Species on the poaching of elephants in Africa. The lifting of the ban on ivory sales is discussed.
