Copyright law - derivative works - Seventh Circuit holds that mounting copyrighted notecards on ceramic tiles does not constitute preparation of derivative works in violation of the Copyright Act
Article Abstract:
The US 7th Circuit Court of Appeals in 1997's Lee v. A.R.T. Co. correctly concluded that the transference of copyrighted works to a new display medium does not constitute creation of derivative works under section 106(2) of the Copyright Act. The defendant had purchased the plaintiff's note cards and mounted them on tiles which it thereafter sold. The court was correct not to follow the overbroad 9th Circuit rule which limits public access to copyrighted materials beyond that contemplated by the statute's authors. However, the court incorrectly confined its analysis to economic interests.

Article Abstract:
The author analyzes a decision of the 9th Circuit Court of Appeals which held that Title 1 of the Electronic Communications Privacy Act protects stored Internet communications, not merely those in transit. The decision's implications with respect to the statutory authorization for Internet wiretaps is discussed.
