Courts, Congress re-examine nondrug products; makers of dietary supplements now can tout health benefits with less FDA interference
Article Abstract:
The 1994 Dietary Supplement Health and Education Act allows manufacturers to make certain health claims for dietary supplements without petitioning the FDA. These include statements claiming a benefit related to a classical nutrient deficiency disease; declarations of general well-being from consumption of a nutrient or other dietary ingredient; and claims about the role of a nutrient or dietary ingredient with respect to the structure or function of the human body.

Courts examine whether judicial review of arbitration awards can be expanded by contract and whether federal agencies can agree to binding arbitration
Article Abstract:
Companies should keep in mind when drafting arbitration clauses that their judicial review tends to be extremely limited. For example, people in the securities industry or franchisees may feel it is in their interest to provide for more judicial review. Limited review is consistent with the professed goals of arbitration, namely, speed, lesser expense and finality. Federal courts have split on whether such review is permitted.
