Dead men need not talk
Article Abstract:
Attention has focused on the attorney-client privilege with the Vince Foster case, and rather than give a definitive answer as to the radical modification of the privilege, the court should continue the legal tradition of deciding the merits of privilege questions for purely utilitarian reasons. In the Foster case, the court should have ruled the privilege to be qualified, and with a strong showing of need, communications about information which was discoverable before Foster's death must be disclosed now.

The author discusses the difficulty of defining what trade secret law protects from misappropriation now that lawsuits in this area are becoming more common. The author distinguishes six categories of trade secret theft, as well as noting the the nonexclusivity of trade secret rights and the importance of flexibility and timing.
