Economic uncertainty spurs new debt deals; flagging conditions in emerging markets complicate new and existing project financing
Article Abstract:
Lower commodity prices, the Asian economic crisis and adverse economic conditions in Latin America, and decreased value of some local currencies mean complications for new and existing project financing. The financial restructuring of a project is lenders' best option in these situations, preferably to stretch out the maturities and maybe agree on a short moratorium for repaying the principal. Lawyers, merchant bankers and other professionals will have much to do in such restructurings.

Pornography prosecution in Germany rattles ISPs; Internet access providers face uncertainty regarding liability after conviction of former CEO
Article Abstract:
The prison sentence of Felix Somm, CEO of CompuServe GmbH, mainly for making child pornography available to Germans who accessed information from US news servers, is based on the theory that CompuServe Inc's wilful failure to delete hard-core pornography in order to make a profit. The ruling also found that Somm knew about the data and deliberately promoted its dissemination as head of CompuServe GmbH. The Somm decision was based on the 1997 German Teleservices Act.

Business crime; regarding gratuities
Article Abstract:
The federal gratuity statute, at 18 USC 201(c), includes barring gifts, other than as provided by law, of anything of value to any former or current public official or person selected to be such an official because of official acts which might be performed. Rulings handed down in 1999, both arising from the independent counsel's investigation of former Agriculture Secretary Mike Espy, are discussed.
