Employee benefits tax provisions of the Small Business Job Protection Act
Article Abstract:
A number of provisions simplifying qualified retirement plan administration and taxation as well as a few revenue-generating provisions are included in the Small Business Job Protection Act of 1996. Nondiscrimination testing has been simplified by the addition of safe harbors for the actual deferral percentage test and the actual contribution percentage test. Distributions are no longer required to begin after reaching age 70 1/2 for participants not yet retired. Among other changes, the Act also establishes Savings Incentive Match Plans for Employees for small businesses.

The changing status of the nondeductibility of otherwise reimbursable employee business expenses
Article Abstract:
Several Tax Court decisions have eroded the principles established in such cases as Heidt v Commissioner and Deputy v Du Pont. These two cases established that employees could not deduct reimbursable business expenses. The first case to affect the decisions in the two cases was Primuth v Commissioner in 1970. This case expanded the definition of an employee's trade or business and allowed employees to deduct employment agency fees when looking for a job in the same field but with a different employer.
