Executive Order 12,630: a President's manipulation of the Fifth Amendment's just compensation clause to achieve control over executive agency regulatory decisionmaking
Article Abstract:
Executive Order 12,630, entitled Governmental Actions and Interference with Constitutionally Protected Property Rights, should be repealed and the attempt to codify it through the proposed Private Property Rights Act should be rejected by Congress. The order was promulgated by President Reagan as part of an effort to restrict the actions of regulatory agencies. The order requires agencies, when conducting cost-benefit analyses, to factor in additional costs for any regulations with takings implications. The result is that many regulations are judged too costly to put into effect. However, the order exaggerates the economic threat posed by takings law.

Encryption, justiciability, and the First Amendment
Article Abstract:
The Dept of Commerce encryption licensing scheme unconstitutionally infringes the 1st Amendment rights of those attempting to be encryption exporters. The Clinton Administration intentionally circumvented the Northern District of California's securing of 1st Amendment rights in Bernstein v. Dept. of State. Congress should act to properly balance national security interests against 1st Amendment rights to concur with the US Supreme Court's decision in Freedman v. Maryland.
