Expert witnesses found credible by most jurors
Article Abstract:
The National Law Journal/Lexis poll of 1992 jurors found a high level of faith in expert evidence. Expert evidence was given in two-thirds of the cases and two-thirds of the jurors found that evidence convincing. Almost all of the criminal jurors who heard expert evidence found it convincing. Half of the civil jurors who heard expert evidence found it convincing. A third of the civil jurors surveyed said the expert evidence had a substantial impact on their decision, and over two thirds of criminal jurors had the same opinion on their cases.

A district court's ruling limiting consultation with witnesses during deposition could restrict longstanding practices and hinder representation of a client
Article Abstract:
A federal district court ruled in Hall v. Clifton Precision Systems that counsel could not confer with a client after the start of a deposition except when deciding on the assertion of a privilege. These rules may conflict with a defense lawyer's duty to represent a client zealously and witnesses should be thoroughly prepared prior to trial. Solutions to the problem of deposition abuse already existed before this ruling, ones which did not conflict with legal ethics.
