International criminal antitrust investigations: practical considerations for defense counsel
Article Abstract:
Defending multinational corporations that may be under investigation for antitrust violations in more than one country can be very complex because counsel must be aware that actions taken in one case can affect the decisions made by prosecutors in another country. The complications that prosecutors face often center on gathering information from corporate defendants that operate in multiple jurisdictions. Enforcement may be simplified by enactment of treaties under the US International Antitrust Enforcement Assistance Act of 1994.

Should the Fair Labor Standards Act enjoy extraterritorial application? A look at the unique case of flags of convenience
Article Abstract:
The jurisdictional reach of the Fair Labor Standards Act should be liberally construed so that ships registered under foreign flags for financial convenience can not avoid US minimum wage and worker safety laws. The importance of fair labor standards and the need to protect American labor and production from cheap labor practices justify abandoning the traditional view that domestic laws do not apply outside US territory.
