FLCs face licensing hurdles in host countries; despite ABA efforts, foreign legal consultants are subject to inconsistent rules worldwide
Article Abstract:
US attempts to foster global legal practice through promoting the foreign legal consultant (FLC) have gone up during the last five years. The ABA has been the FLC's main promoter, and the US Trade Representative has, at times, assisted that organization. The laws pertaining to the marketing of the FLC worldwide are the North American Free Trade Agreement (NAFTA) and the General Agreement on Trade in Services (GATS). Rules on licensing FLCs without examination exist in over 20 US jurisdictions and several Canadian provinces, and the ABA, the International Bar Assn, NAFTA and the European Union have model rules. This profusion of rules shows that there are no shortcuts to global legal practice, but that it grows in discrete jurisdictional pieces.
