Reno to lawyers: consider ADR

Article Abstract:

Attorneys should know when to use mediation, arbitration or litigation, and should help educate the public in conflict resolution. Litigation is not the only avenue to resolving conflict, sometimes emphasis on winning a trial can damage conflict resolution. Appropriate dispute resolution can most wisely resolves a dispute and can involve trial or mediation. Attorneys should help establish conflict resolution education programs in schools and communities.

Legal ethical issues which have arisen with the expansion of law firms in size, practice fields, and territory are explored with a focus on problems of conflicts of interests which are not adequately addressed by the Model Rules of Professional Conduct.
