Fee fie foe firm: Big Four gobble up lawyers

Article Abstract:

Questions of conflict-free representation and client protection arise with the many mergers of law firms with large accounting firms, in fact, some attorneys fear that law firms might disappear into the latter. Attorneys taking jobs with accounting firms might argue that they were no longer practicing law and thus did not have to follow ethical rules, denying clients the protections the profession has developed. These problems are the theme of a fictional conversation on the subject.

Internal investigations

Article Abstract:

An internal investigation should be carefully considered and planned. The person or group who will conduct the investigation must be determined, and the investigation should include a fact gathering and review process, and an interview process. Attorney-client privilege and work product issues must be evaluated, and a decision made on whether to contact the government and third parties.

Lawyers and confidentiality

Article Abstract:

The attorney-client confidentiality privilege should be abolished. It provides little benefit to clients or society and instead encourages the use of legal services. The self-defense exception to the privilege clearly shows that it protects attorneys from fee losses and malpractice claims, rather than serving clients or society's welfare.
