Financing exploration: requirements of federal and state securities laws
Article Abstract:
Compliance with the New Mexico Blue Sky Law should not represent much of a problem for and oil company raising money through an offering registered under the Securities Act of 1933 or exempt under Rules 505 or 506 of Regulation D. The most simplified registration procedure is registering offerings registered with the SEC with New Mexico by coordination. Offerings exempt under Rules 505 and 506 of Regulation D are exempt from registration in New Mexico under the Uniform Limited Offering Exemption. The intrastate exemption has a different procedure.

Under CERCLA, government cannot collect expenses for overseeing private party cleanups
Article Abstract:
The Third Circuit's decision in United States v. Rohm and Haas Co to disallow the recovery of costs incurred by the government in overseeing a private party's cleanup of a contaminated waste site may encourage private cleanups. The decision was based on an interpretation of CERCLA sections 106 and 107 governing private party cleanups and government cost recovery and on CERCLA's remedial nature and its intent of encouraging cost-effective cleanup. Private parties are more likely to opt for private over public cleanup if no recovery is allowed.

Facilitative government: an experiment in federal restraint
Article Abstract:
The EPA encouraged a community north of Boulder, CO, to resolve a contaminated water site on its own rather than expect the EPA to assume all responsibility for correcting the problem. The EPA worked with community parties to form agreements. Such facilitative government intervention reduces costs and prevents litigation between the community and the EPA.
