Obtaining evidence in England: the role of solicitors and barristers
Article Abstract:
US attorneys who need testimony from uncooperative witnesses in the United Kingdom need to follow the rules in the Evidence (Proceedings in Other Jurisdictions) Act 1975. The request for evidence must be made through a US court. English solicitors may be hired to save travel expenses and the solicitors may retain barristers who represent their clients. Appropriate use of solicitors and barristers can minimize or overcome potential difficulties in obtaining evidence.

Ethical and legal considerations in interviewing and contacting potential witnesses in litigation: Rule 4.2 restrictions and discovery practices
Article Abstract:
Rule 4.2 of the ABA Model Rules of Professional Conduct limits the situations in which an attorney can interview potential defense and plaintiff's witnesses without the consent of the opposing side's counsel. The scope of this rule and steps that should be taken before interviewing potential witnesses are discussed in detail, from the point of view of insurance defense counsel.
