In the spirit of mediation; joint committees sort through current laws in quest of uniform standards
Article Abstract:
The ABA Section on Dispute Resolution is cooperating with the ABA National Conference of Commissioners on Uniform State Laws to draft standards for confidentiality in mediated settlements. The rules governing this process are spread through many laws, common law privileges and contractual terms. The standardization of mediation law would represent its legitimization as a mainstream dispute-resolution mechanism. Effective mediator confidentiality would make statements to a mediator both undiscoverable and inadmissible.

Limiting mental health inquiries: ABA urges bar examiners to narrow focus on current, recent disabilities
Article Abstract:
The American Bar Assn at its 1994 annual meeting called on state bar examiners to restrict their questions on mental health and fitness. Such questions can discourage applicants from seeking needed help, and may disqualify worthy candidates. The questions should focus narrowly on current fitness to practice law and on the candidate's conduct and behavior, not past treatment. MN's approach is exemplary and the ABA Commission on Mental and Physical Disability Law commends it as a model for other state bar assns.

Seniors earnings test 'outdated;' ABA urges Congress to raise Social Security cap on older workers
Article Abstract:
The Contract with America's Senior Citizens Equity Act marks another attempt to modify the Social Security earnings test. The ABA Senior Lawyers Division favors liberalizing the earnings test as well, feeling that allowing more older, experienced Americans to work could only enhance the competitiveness of the US economy. The $200 million in administrative costs the Social Security Administration spends each year on test-related issues is another reason to alter the test.
