Issues relating to tort liability for injuries on adjacent premises

Article Abstract:

Property owners and occupiers should guard against lawsuits filed by persons injured on premises adjacent to their own due to plaintiffs' claims accepted by some courts that such property holders owe other persons a duty of care. Exceptions to the general rule of nonliability for dangerous conditions existent on adjacent properties are emerging and should be clearly defined by the judiciary. Property holders should remedy hazardous conditions which they discover.

The plaintiff's arsenal: emerging theories of liability in managed health care

Article Abstract:

Legal representatives of the managed health care industry should be aware of three possible spheres of liability which grow in importance with increases in health care costs and attempts to manage those costs. Delivery, management, and financing of managed health care are all fraught with possibilities of human and institutional error. The industry can limit its liability by instituting risk management measures.
