Local government law - affordable housing - refining municipal obligations under Mount Laurel, the New Jersey Supreme Court hints at a new conception of regional responsibility
Article Abstract:
The New Jersey Supreme Court, in the case of Bi-County Development of Clinton, Inc. v. High Bridge, ruled that the town of High Bridge did not have to let a neighboring township's housing development connect to its sewer system. The Court ruled that the state's constitutional requirement to offer affordable housing did not apply to the town of High Bridge in this case. The housing developer was not actually constructing low-cost housing, but simply contributing to a fund for that purpose.

Education law - school funding - New Jersey Supreme Court criticizes Quality Education Act of 1990
Article Abstract:
The New Jersey Supreme Court in Abbott v. Burke focuses on funding discrepancies rather than substantive quality in evaluating the constitutionality of the state's public education. Although the decision is critical of legislature's response in the Quality Education Act of 1990, the remedy of funding equalization mandated by the court does not provide any guarantee of quality improvement and thus fails to uphold the education clause of the state constitution.
